Individuals wishing to make a purchase via the Casual Chic https://casualchic.shop e-commerce website, hereinafter referred to as the "User".

For the purposes of these General Terms and Conditions of Sale, it is agreed that the User and Casual Chic will be collectively referred to as the "Parties" and individually referred to as the "Party" and that the User who has validated an order will then be referred to as the "Buyer". The rights and obligations of the User necessarily apply to the Buyer.

Users wishing to purchase from the site declare that they are over 18 years of age and have full legal capacity or the authorization of a parent, guardian or tutor.

Any order for an Item offered on the site implies consultation and express acceptance of these General Terms and Conditions of Sale, without this acceptance being conditional on a handwritten signature by the User.

The present General Conditions of Sale apply, without restriction or reserve to all sales concluded by Casual Chic with non-professional purchasers, wishing to acquire the articles offered for sale by the Seller on its Internet site mentioned above.

These General Terms and Conditions of Sale are accessible at all times on this website and shall prevail, where applicable, over any other version or any other contradictory document.

In the absence of proof to the contrary, the data recorded by Casual Chic constitutes proof of all transactions.

In accordance with legal provisions, it is reminded that the validation of an order is carried out by clicking on the "I confirm my order" button. This validation constitutes an electronic signature which, between the Parties, has the same value as a handwritten signature and is proof of the completeness of the order and of the payability of the sums due in execution of the said order. In all cases, the on-line provision of the credit card number and the final validation of the order shall constitute proof of the completeness of the said order and shall constitute payment of the sums incurred by the seizure of the items appearing on the order form.

Access to the Casual Chic site is subject to normal Internet connection conditions. The User will not be charged any additional connection fees.

These General Terms and Conditions of Sale are subject to change. The conditions applicable are those in force on the date your order is placed. The Buyer is responsible for editing and saving these conditions.

Art. 1.
The purpose of these General Terms and Conditions of Sale is to define, exclusively in respect of the relations that the Parties establish on the Internet, their respective rights and obligations arising from the online sale of the products offered on the site. These conditions regulate all the steps necessary for placing an order and ensure the follow-up of this order between the contracting parties.

The Parties agree that their relationship shall be governed exclusively by the present contract. In the absence of any condition, the contract shall be deemed to be governed by the practices in force in the distance selling sector whose companies are based in Belgium.

Art. 2 Items - Prices
2.1 ITEM
Part of the items is purchased directly from suppliers to constitute a pre-stock, the other part is ordered post-sale according to the number of orders placed by Buyers.

In the event of unavailability of an item after the order has been placed, due to a delivery problem on the part of our suppliers or a stock discrepancy, the Purchaser will be informed by e-mail as soon as the information communicated by the supplier or the logistics department has been received. The unavailable item will then be cancelled and reimbursed, while the rest of the order remains firm and definitive.

2.2 PRICES
Prices are quoted in euros and include any discounts and VAT applicable on the date of order.

The prices indicated are guaranteed within the limits of available stocks, except in the event of significant changes in charges, in particular VAT, and except in the event of typographical error or omission. The prices indicated do not include delivery charges, which will be invoiced in addition and will be specified to the User at the time of final validation of the order.

Casual Chic reserves the right to modify its prices at any time but the Articles will be invoiced on the basis of the prices in force at the time of the recording of the order, subject nevertheless to the availability of the aforementioned Articles.

When a validated order contains one or more erroneous elements (price, description, photo, coupon ...), Casual Chic reserves the right to cancel it and to proceed to the reimbursement of the latter.

Art. 3 Registration and validation of the order
3.1 NAVIGATION WITHIN THE WEBSITE
The User can take note of the various Articles offered with the sale by Casual Chic on its site.

The User may freely browse the various pages of the site, without being bound by any order.

3.2 REGISTRATION AND PASSWORD
Registration is necessary and mandatory to place an order. The User must accurately complete the "Register" form available in the "My Account" section. In particular, he/she must include the information required for identification, and in particular his/her first and last names, postal address, valid e-mail address and password.

Casual Chic guarantees the confidentiality of data transmitted after the password has been entered. The User is responsible for the use of his/her password. The User is responsible for maintaining the confidentiality of the password. If you lose your password, you should contact Casual Chic as soon as possible to request a new password.

In the event of a forgotten password, the User may obtain a new one by clicking on the "Forgotten password" link displayed in the identification section. The reset procedure will be sent by e-mail.

When creating an account, the User may authorise Casual Chic to send him/her invitations to sales and announcements from the Casual Chic Team by e-mail.

3.3 REGISTERING AN ORDER
The User places his order via an Internet connection enabling him to browse the site. In order to be accepted, the order must contain all the information required for processing. In addition, any order implies acceptance of the General Terms and Conditions of Sale, and of the prices and descriptions of the items available for sale.

It is not possible to place an order from a country not included in the list of destination countries authorized by Casual Chic.

If the User wishes to place an order, he/she will select the various items that interest him/her and express his/her interest by clicking on the "Add to basket" box.

At any time, the User may :

- Obtain a summary of the Items selected, by clicking on "My basket".

- Continue shopping by clicking on "Continue shopping".

- Complete your selection of items and order them by clicking on "I confirm my order".

To order the items selected in the shopping basket, the User must identify himself, either by entering his e-mail address and password if he has already created an account with Casual Chic, or by filling in the "Register" form if he has not.

The User is informed and accepts that entering these two identifiers to access his customer account (email address and password) is proof of his identity and confirms his consent.

Once the User is identified, an order summary will appear on the screen, specifying: the nature, quantity and price of the item(s) selected by the User, and then the User must validate the delivery address, as well as the amount of the delivery charges, the order total, the User's contact details and the delivery address.

Casual Chic is unable to consolidate multiple orders.

3.4 DEFINITIVE ORDER CONFIRMATION
Once the User has read the details of his/her future order, and once all the information requested has been completed by the User, the User must pay for the order in order to confirm it definitively.

In the case of payment by credit card, the User will be asked to provide certain information about the credit card used:

- The name of the cardholder,

- Credit card number,

- The expiry date,

- Its cryptogram number.

It is specified that with an immediate payment by credit card, means of payment proposed by Casual Chic on its Internet site, the User will carry out his payment via the site of Casual Chic using the system TPE (Terminal de Paiement Electronique) of BNP. The Casual Chic site is secured by S.S.L. (Secure Socket Layer) encryption signed by the OGONE organisation in order to protect all data linked to means of payment as effectively as possible. In this way, the User's bank details are retransmitted to the bank, which is itself protected by S.S.L. encryption, and at no time will the User's bank details pass through Casual Chic's computer system. Casual Chic shall not be held liable in this respect.

The User can save his bank details so that he no longer needs to enter them each time he places an order.

As soon as he validates his payment by credit card, Paypal or bank transfer, the order is recorded and becomes irrevocable. The User becomes a Buyer. The order form will be recorded on the computer registers of Casual Chic, themselves stored on a reliable and durable, and will be considered proof of contractual relations between the Parties.

3.5 ORDER CONFIRMATION
Once payment has been confirmed by credit card (including card number, expiry date and cryptogram), Paypal or bank transfer, a summary of the Purchaser's order will be sent by e-mail, upon receipt of the order form, to the e-mail address indicated by the Purchaser at the time of ordering. This confirmation will include all the constituent elements of the contract between the Parties, as well as an estimated dispatch date.

Casual Chic recommends that the Purchaser retain or print the order confirmation email. However, documents archived in Casual Chic's computer systems will be considered legal proof. A summary of the order will also be displayed in the customer account.

Art. 4. discount vouchers, sponsorship
4.1 DELIVERY OF COUPONS
Discount vouchers are represented by a code which must be entered or which has already been allocated to the customer account. A code may be sent by e-mail or post during special operations, or the customer will be informed by e-mail of the allocation of a coupon in his customer account.

4.2 CONDITIONS OF USE OF VOUCHERS
Unless otherwise specified, in particular in relation to the use of a purchase or discount voucher when registering a first order, several purchase or discount vouchers may be used on the same order. Under no circumstances may they be converted into foreign currency. Coupons have an expiry date that cannot be changed. No new coupon may be issued or allocated to a User to replace an expired and unused voucher.

The application of a purchase or discount coupon necessarily implies that the value of the basket (before calculation of delivery costs) is greater than the value of the purchase or discount coupon, except in the case where the particular conditions of use of the said purchase or discount coupon specify a minimum purchase amount (before calculation of delivery costs). In this case, the value of the basket (before calculation of delivery charges) must be greater than the value of the minimum purchase required to use the coupon.

Under no circumstances may a Purchaser request Casual Chic to deduct from an order already validated and paid the value of a voucher or discount code that was not entered, selected or was defective when the order was placed.

Vouchers are valid only on the Casual Chic website. They cannot be used to purchase gift vouchers or GIFT CARDs.

4.3 USE OF PURCHASE OR DISCOUNT VOUCHERS
In order to benefit from the discount associated with a purchase or discount voucher, the User must enter the code assigned to him in the "Do you have a gift card?" window or click on the "Use the purchase or discount vouchers and gift certificates you have collected" link.

After entering or selecting the voucher or discount, the User must click on the "Ok" or "Validate" button. The discount will be immediately deducted from the amount of the order.

4.4 REFUND OF AN ORDER CONTAINING A VOUCHER OR DISCOUNT
When an order contains a voucher or discount, the amount of the voucher or discount is allocated to all items in the order in proportion to their respective values. Any refund of an item in an order, for whatever reason, is made after deduction of the associated voucher or discount.

4.5 SPONSORSHIP
Sponsorship enables the User to obtain discount vouchers for the shipment of the first order of each of his referrals.

The discount code is then automatically displayed in the User's customer account. The sponsorship voucher has the same conditions of use as other vouchers issued by Casual Chic, with the exception of its validity period, which is one (1) year from the date of issue.

All forms of mass sponsorship are prohibited. Self-sponsorship activities in which the User registers with different e-mail addresses in order to carry out a fictitious sponsorship enabling him/her to obtain benefits are also prohibited. Only one customer account per household.

If Casual Chic becomes aware of serious irregularities on the part of a User participating in the sponsorship program, Casual Chic may take the necessary steps to put an end to such irregularities and to cancel, as a result, any benefits and other discounts that may have been improperly granted to such User.

The purchase of gift vouchers by the sponsoree does not generate any sponsorship coupon for the sponsor.

Art. 5. Payment
5.1 ORDER AMOUNT
The amount due by the Buyer is indicated before the order is validated by the User and on the order confirmation sent by e-mail by Casual Chic to the Buyer.

5.2 PAYMENT METHODS
Payment can only be made over the Internet by :

- Card = Carte Bleue, Visa, Eurocard/Mastercard or Bancontact.

- Paypal

5.3 Payment confirmation

The order will be considered valid after confirmation of the bank payment agreement. In the event of refusal by the bank, the order will be automatically cancelled.

In any case, Casual Chic reserves the right to refuse any order or any delivery in the event of litigation with the Purchaser, of non-payment total or partial of a preceding order by the Purchaser, of refusal of authorization of payment by bank card of the banking organizations. Casual Chic cannot be held responsible in the event of a dispute.

5.4 PAYMENT DELAY
When the Buyer pays with an immediate debit card, the Buyer's bank account is debited within 2 to 5 days of the order being placed. This period varies depending on the banking institution.

In the case of a deferred debit card, the Purchaser's bank account will be debited for the amount of the order under the same conditions as usual debits.

Art. 6. Delivery
6.1 SHIPPING AND DELIVERY TIME
The shipping and delivery time of an order corresponds to an indicative time from the day following the validation of the order by the Buyer.

This delay takes into account the estimated time required for Casual Chic to process and receive the items that make up the order. In no case it could be opposable, but in the event of unusual delay, an e-mail will be addressed to the Purchaser.

The average dispatch time is 24 working hours, but can be between 48 working hours and 1 week. To this must be added the carrier's delivery time to the delivery address (2 working days).

6.2 SHIPPING
Items are shipped to the delivery address indicated by the Buyer in his/her customer account. If the Buyer has several delivery addresses registered in his/her customer account, he/she may select one before finalizing his/her order and proceeding with payment.

Casual Chic declines all responsibility in the event of excessive delays in delivery attributable to the postal services or carriers in general, as well as in the event of loss of the Articles during transport.

Casual Chic undertakes to dispatch the Purchaser's order within the estimated time displayed when the order is placed. In the event that this deadline is exceeded by more than one week, Casual Chic will, at the customer's request, cancel the sale and reimburse the customer within 72 hours.

6.3 DELIVERY
Packages are generally delivered within 2 working days of dispatch. If the Purchaser is not present when the parcel is presented at the delivery address, a notice will be left by the Carrier in the recipient's letterbox to inform him of this. If the Purchaser is still not present when the carrier makes its second visit, a notice will be left in the mailbox stating that the parcel has been delivered to the nearest Parcel Shop. The Buyer, with proof of identity, must then collect the parcel from the Parcel Shop indicated on the delivery notice within 5 days at the latest.

In the event that the Purchaser is unable to collect the package, it will be returned to Casual Chic's warehouse. Casual Chic will then offer to reship the package to the Purchaser upon payment of the return shipping costs. This last procedure also applies to parcels returned by the Carrier following an incorrect delivery address or an unknown recipient.

6.4 LOST PARCEL
If, within 30 working days following the dispatch of the order, the Purchaser has still not received the parcel, neither a delivery notice nor precise information via the online parcel tracking system, he/she must contact the Carrier using the parcel tracking number available in his/her customer account and in the confirmation e-mail sent to him/her when the parcel was dispatched.

If the Carrier finds no trace of the parcel, the Buyer must contact Casual Chic's Customer Service as soon as possible at the following address casualchicbe@gmail.com

Customer Service will then open an investigation with the Carrier. The Buyer will receive an e-mail informing him/her that an investigation has been opened and that response times vary between 10 and 30 days from the opening of the investigation. If the parcel is found, it will immediately be returned to the Buyer. If the package is considered lost, Casual Chic will refund the total amount of the order.

6.5 NON-CONFORMING DELIVERY
Despite the care taken in preparing orders, some items in an order may be defective, missing or non-conforming.

This is why, upon receipt of the order, the Buyer must check the conformity of the Articles received and must refuse any packages opened, torn and/or repackaged by the carrier. Any anomaly concerning the delivery (missing, broken, non-conforming or damaged parcel) must be notified to Casual Chic's Customer Service within 3 days of receipt of the parcel. Any complaint formulated after this time will be rejected and Casual Chic will be released from any responsibility.

If the above conditions are met, Casual Chic will then either send an electronic voucher for the value of the defective item(s), or reship the missing product (subject to the Purchaser's request being justified). Casual Chic reserves the right to request, at its own expense, that the Buyer return the defective item(s) to Casual Chic. The reimbursement or the issue of a voucher will take place within a maximum of 30 days from the date of receipt of the parcel by Casual Chic.

6.6 DELIVERY OUTSIDE BELGIUM
Any order placed on the site and shipped outside Belgium may be subject to taxes or customs duties. These delivery costs are the responsibility of the Buyer. Casual Chic is not obliged to inform the User of any taxes or customs duties applicable to the country of delivery.

6.7 DELIVERY
Art. 7 Right of withdrawal and returns
The Buyer has a period of fourteen clear days in which to declare his return, unless expressly stated otherwise. The withdrawal period runs from the day of delivery of the order. If the items are returned with an additional delay to the 14 days imposed by Casual Chic, Casual Chic reserves the right to deduct 10% of the value of the returned items.

The Buyer may contact Casual Chic Customer Service by logging into his/her customer account or by writing to casualchicbe@gmail.com.

Items subject to retraction must be returned in their original packaging to the following address: Casual Chic - Avenue Capouillet 15, 1410 Waterloo. Items must be returned in new condition and fit for resale. Items must be accompanied by all accessories.

Items on sale cannot be returned, exchanged or refunded.

Items returned must have undergone minimal use, i.e. they must have been tried on for a few minutes and must not show signs of prolonged use.

If the aforementioned conditions are met, Casual Chic will issue an electronic voucher valid for 6 months or a refund, within a maximum of 30 days from the date of receipt by Casual Chic of the parcel, of the sums paid by the Purchaser, with the exception, however, of the cost of sending and returning the Articles, which remain the responsibility of the Purchaser.

The costs and risks of return shipment are borne by the Buyer. Consequently, it is up to him to preserve all the proofs of this return. Casual Chic advises the Buyer to return the Products by registered mail or by any other means that provides proof of return. These proofs of shipment must include the following information: recipient's address, date of shipment and package number.

The Buyer may also exchange his/her purchase at any Casual Chic Sprl sales outlet. The Buyer will also be able to benefit from a credit note in the event of return in the points of sale, but in no case from a refunding. If the Buyer wishes to be reimbursed, he/she must return the order following the normal procedure.

 

Art. 8. Data Protection
8.1. PERSONAL INFORMATION
The provision of personal information collected in the context of distance selling is compulsory, as this information is required for the registration, processing and delivery of orders and for the preparation of invoices. This information is strictly confidential. Failure to provide this information will result in automatic rejection of the order.

In accordance with the law, the processing of personal data collected on the Site has been declared to the Commission Nationale de l'Informatique et des Libertés (CNIL). The User has the right to access, modify, rectify and delete data concerning him or her. To exercise this right, the User should send a letter to Casual Chic's Customer Service Department (address above) or to casualchicbe@gmail.com.

Finally, Casual Chic may communicate personal information to its commercial partners. The User may receive commercial offers from third parties. In this respect, it is specified that unless the User expressly refuses, his/her postal address may be communicated to Casual Chic's commercial partners. However, the User's e-mail address may only be communicated to Casual Chic's business partners with the User's express consent. Of course, the User retains the possibility of refusing such communication, either by not giving his consent at the time of registration and/or validation of his order, or by expressing his refusal a posteriori by mail, in accordance with the paragraph above.

8.2. COOKIES
The Site places a cookie on the User's computer.

This cookie records information relating to browsing on the Site, and stores the information entered during the visit. In this way, the User will not need to re-enter this information the next time he or she visits the Site. Casual Chic will be able to consult this information during future visits. This cookie does not allow the User to be identified.

8.3. WEB BEACONS
Some of the Site's web pages may contain electronic images or "web beacons", which make it possible to count the number of visitors to the page.

These web beacons may be used to measure and improve the effectiveness of our pages.

In any event, the information obtained via these tags is strictly anonymous and is used simply to compile statistics on visits to certain pages of the Site, in order to better serve the Users of our Site.

Art. 9. Guarantees and responsibilities
9.1 INFORMATION ON THE ARTICLES
For each article on sale on the Site, Casual Chic undertakes to provide a description sheet to present its essential characteristics, within the limits of the information provided by the suppliers. Casual Chic makes every effort to provide the User with as much information as possible to enable the User to become familiar with the items before placing orders.

Despite all the care taken in writing these descriptions, errors may occur. If the User notices an inconsistency, he/she may contact Customer Service to inform them. Casual Chic will then proceed as quickly as possible to correct these errors.

The photographs as well as the descriptions of the articles are not contractual and Casual Chic will not be able to in no case to be held responsible for the errors which could exist.

In particular, the images and colors of the items displayed on the site may not be exactly faithful to the actual colors of the items due to the effect of the Internet browser used and the resolution of the User's screen.

Casual Chic sells top-quality items. However, some of the items sold have "vintage" effects and show deliberate deterioration by the manufacturer (holes, discoloration, whiskers, permanent creases, etc.). These items have been treated to give them a special appearance. The details added to the fabric are sometimes done by hand. It is therefore impossible to guarantee the homogeneity of all items. It is therefore normal to observe differences between the photographed item and the item delivered.

9.2 LEGAL WARRANTY
Casual Chic acts as an agent for professional suppliers. The latter guarantee that the articles sold are of first quality and are shipped in good condition, and do not present any defect or hidden defect making the articles unfit for their normal use.

Casual Chic is nevertheless liable for any hidden defects in the goods sold.

In order to benefit from the legal warranty, the following conditions must be met:

- the defect affecting the good must be serious; it must prevent normal use of the good or diminish its properties to such an extent that the buyer would not have bought it or would have offered a lower price if he had known about it;

- the defect affecting the good must be hidden; the seller is not liable for apparent defects, i.e. those that a person of average diligence would have discovered by carrying out basic checks when receiving the product;

- the defect affecting the item must have occurred prior to the sale, even if it became apparent at a later date; the Buyer is subject to an obligation of prudence in the use of his items. Proof of a defect caused by negligence, deterioration or non-conforming use would render ineffective the warranties associated with the item (All causes external to the item such as a shock, a fall, lightning, oxidation, repair by an unauthorized person, exposure to heat, washing incident ...);

- Defects of conformity which appear within six months of delivery of the goods are presumed to have existed at the time of delivery, unless proven otherwise. The seller may rebut this presumption if it is not compatible with the nature of the good or the alleged lack of conformity. A lack of conformity that appears more than 6 months after purchase and less than 2 years after purchase is not presumed to exist at the time of delivery, but must be proven by the buyer for the seller to be held liable (by expert appraisal, for example).

If the conditions are met, Casual Chic will repair or replace the item free of charge. If the item is neither repairable nor exchangeable, Casual Chic will, at the Buyer's option, refund the purchase price of the item in the form of a credit note or return the non-conforming product to you and compensate you for part of the price in the form of a credit note.

For any such request, the Purchaser must contact Casual Chic's Customer Service Department.

9.3 Liability

Casual Chic's liability is limited to the amount of the Buyer's order.

Casual Chic cannot be held responsible for any inconvenience or damage inherent in the use of a computer, a computer network or the Internet. In particular, Casual Chic cannot under any circumstances be held responsible for a break in service, external intrusion or the presence of a computer virus. Casual Chic has only an obligation of means for all the stages of access to the site, in particular the consultation, the filling of form, the placing of order, the payment like any other service available on the site of Casual Chic.

Casual Chic cannot be held responsible for any material, immaterial or physical damage caused by the malfunction or misuse of an item purchased on the Site.

It is up to the User to check with the local authorities the specificities as for the taxes, declarations, prohibitions, possibilities of importation or use of the ordered articles. Casual Chic cannot be held responsible in the event of non-compliance with the legislation of the country to which the items are delivered.

Art. 10 Intellectual property
All elements of the Site, whether visual or audio, including the underlying technology, are protected by copyright, trademarks or patents.

They are the exclusive property of Casual Chic.

Art. 11 Partial invalidity
Should any of the clauses of this contract become null and void as a result of a change in legislation, regulations or a court ruling, this shall in no way affect the validity of and compliance with these general terms and conditions of sale.

Art. 13. duration
The present conditions apply for the duration of the online availability of the Articles offered by Casual Chic.

Art. 14 Force majeure
Casual Chic shall not be liable for the total or partial non-performance of its obligations under this contract, if such non-performance is caused by an event constituting force majeure, in particular in the event of disruption or total or partial strike, notably of postal services and means of transport and/or communications, flood, fire.

Events meeting the criteria laid down by case law will be considered as force majeure.

In the event of a force majeure event, Casual Chic will notify the User/Purchaser within eight business days of the occurrence or threat of such event.

The Parties agree that they shall consult each other as soon as possible in order to determine together how the order will be carried out during the period of force majeure.

After a period of one (1) month of interruption due to force majeure, Casual Chic may not honor the order, and will reimburse the Buyer if necessary.

Art. 15. Applicable law, jurisdiction
The General Terms and Conditions of Sale are governed by Belgian law.

Any dispute arising from the General Terms and Conditions of Sale shall be brought before the competent courts in application of the rules of common law.
